Surrogate Battle: Local Couple Loses Twins to Birth Mother

They couldn't conceive, so they spent more than thirty thousand dollars for a sperm and egg donor. Along with In Vitro fertilization for a surrogate mother who lives on the east side of the state in Ypsilanti.

After the surrogate gave birth in July, the Keho's brought the twins home to a packed nursery. They have double of everything.

That is until the birth mother got a court order one month later to get them back.

"It was the best experience of my life and then when they were taken away it was one of the most traumatic experiences i've ever had," said Amy.

Laschell Baker has been a surrogate twice before and already has four kids of her own.

"I couldn't do it, I just couldn't do it," Baker said.

Baker says it's what she learned after the birth that forced her to take the kids back. Amy Kehoe has been taking medication for a mental illness.

"I would never have worked with a family that had these types of issues, i'm not judging them, they may be good parents, but I can't take that risk," said Baker.

But Amy says her mental illness has been under control for a decade. Her psychiatrist wrote a letter to the judge stating she'd be able to hand the pressure.

"I don't think it's fair to use that as a crutch," said Scott Kehoe about Baker's argument. "I think that her plan was to take the children or keep the children the whole time," he said.

Laschell Baker says it would have been irresponsible for her to give the kids up. She renamed them Peyton and Dani.

Meanwhile the Kehoe's are struggling with having everything they ever wanted taken away. All that's left now are the memories.

They've given up the legal fight to keep the kids saying it costs too much, legally and emotionally.

"I was just gullible and foolish, I made really poor decisions based on my emotions that I wanted a child so bad," said Amy.

In Michigan the law favors the birth mother. Plus, there's a law that prohibits paying someone to carry a baby. So the contracts can't be enforced in the courtroom.

The Kehoe's say they never paid Baker, just reimbursed her for medical fees.
